Patents
protect a technical solution to a target problem which can consist of solving drawbacks inherent to known technologies or in providing an alternative to said technologies. The degree of protection conferred by a patent largely depends on the wording of the document filed in the official organization responsible for the grant procedure. Furthermore, receiving a grant for a patent application is many times conditional to the result of an examination of the novelty and inventive step, among other requirements. Due to the complexity of this process, the involvement of an Intellectual Property Agent is required in order to properly defend the application.

Each case is treated individually because we believe that each invention demands a customized protection strategy. A trademark is a distinctive symbol which consumers use to identify different goods and/or services of companies or individuals. The essential role of trademarks in commerce reflects this fact and justifies the importance of promoting (marketing) and protecting (intellectual property) them.

Our job is to obtain maximum protection for our client at both national and international levels. Particularly consists in preparing, writing and filing with the corresponding Intellectual Property Office any type of registration document for a distinctive symbol. As well as registration and opposition proceedings in the Spanish Patent and Trademark Office (SPTO), the World Intellectual Property Organization (WIPO), the Office for Harmonization in the Internal Market (OHIM) or other such agencies and offices.


The experience and constant renewal of knowledge of the professionals employed by the firm allows us to quickly and meticulously adapt to existing legal concepts and to those that each individual jurisdiction approves in order to give our clients the response they need.

The Legal Department at SUGRAÑES is made up of five practicing attorneys who defend our clients’ interests both in Spain and abroad. The term “industrial design” is used to describe the projected form for objects that can be mass produced.

Designs giving an overall impression differing from the impression conveyed by others and complying with certain novelty requirements can be registered (e.g.: electrical appliances, machine parts, stamps, clothing accessories, furnishings, jewels, shoes, vehicles, toys, lighting fixtures, etc.)

Industrial design is conceived as a shape-related innovation of the appearance of the good or its ornamentation.



The same concept is also contemplated for the Community (European Union) level with a similar protection process.

Evaluating possible variants and making the depictions (drawings and/or figures) that determine the optimal scope of protection for the design or designs, using different software programs for processing drawings, diagrams and/or photographs.


   


The distinctive symbol in Internet, colloquially known as the domain name, is becoming essential today given the existing importance of new technologies. Recognition and protection of a company’s identity in the world wide web of Internet is a must in today’s market.
